Definitions

“Site” means this URL “www.lumiraventures.com” and any replacement thereof for which Lumira provides Site Material;

“Lumira”; “Lumira Ventures”; and “Lumira Capital” means Lumira Capital Investment Management Inc.;

“Site Material” means the form and content of everything (including all text, HTML, other code, multimedia presentations and images) available at the Site, and its selection and arrangement, whether owned or provided by Lumira or others;

“User” or “you” means an individual living person who has access to the Site.

Your Use of the Site

This Site is operated by Lumira. By using The the Site and/or Site Material, you agree to these Terms of Use. Lumira may modify these Terms and Conditions at any time and such updates become effective immediately on posting. You acknowledge that by using the Site after we have posted changes, you are agreeing to the Terms of Use as modified. If you do not agree with these Terms of Use, your sole remedy is to discontinue use of the Site.

Lumira grants you a (limited non-exclusive license to use the Site for informational and educational purposes only.) Lumira reserves all rights it has or may have to the Site and Site Material. Site Materials are protected by law (including laws relating to copyright, trademark and confidential information), and are owned or controlled by Lumira or others. Except as set out herein, your use of the Site does not give you any right or license under any patent, trademark, copyright or other form of legal protection of Site Material.

Lumira allows each User (subject to applicable laws and the terms described below) to read, copy and print Site Material for his or her own personal non-commercial use provided that:

  • the Site Material is not modified
  • materials retain all copyright and other notices that are on the version of this Site
  • no other use, reproduction, distribution, modification, creation of derivative work, publication, transmission or dissemination of Site Material is made in any way without the prior written consent of Lumira.

You agree that Site Material:

  • is provided on an “as is” basis;
  • is not intended as an offer or encouragement to buy or sell anything;

Lumira and its affiliates and associates, and the officers, directors, employees or members of Lumira and its affiliates and associates (the “Lumira Parties”) do not under any circumstances make any recommendations regarding the securities or investment services of any person or entity, or of the advisability of investing in securities generally for any particular individual. Neither the Site, the Site Materials, nor the Lumira Parties:

  • make any representations or warranties as to the merit of any of the securities referred to on this Site or any other site to which a link is made
  • have endorsed or sponsored any of these securities; or

No liability of Lumira

Unless otherwise explicitly provided by applicable laws, Lumira is not responsible for any direct, indirect, special, incidental, consequential, punitive or other damages, however caused, arising out of or in connection with the use of the Site or Site Material, including any business injury, business interruption, loss of use, loss of data, lost profits, or any other financial loss, whether based on contract, negligence or other tortious action, even if Lumira has been informed of the possibility of such damage or action. Any part of these terms that is declared invalid or unenforceable in respect of User shall not apply to User but the unenforceability of such term shall not affect the validity or enforceability of the rest of these terms.

Links – no endorsement

As a convenience to Users, the Site contains links to a number of Sites or other URL addresses not maintained by Lumira (“other sites”). Where the Site contains a link to any other site:

  • You link to the other site at your own risk.
  • Lumira does not assume responsibility for the form, content, accuracy or completeness of anything available at that other site.
  • Lumira’s Privacy Policy and procedures do not apply to the other site. You should find out directly from the other site whether they have any data collection or privacy policy that protects you.

Passwords and Accounts

You are responsible for maintaining the confidentiality of the password used to access your account. Lumira may rely on the authority of anyone accessing your account or using your password and will not be liable for any damages and expenses arising out of or relating to any unauthorized use of such account or password. You agree that you are responsible for all activities that occur on your account.

Lumira may cancel or suspend your account at any time for any reason without any notice or liability to you or any other person.

Lumira Capital Investment Management Inc. reserves all rights in its copyrights and trademarks, including its common law trademarks and trademark applications and registrations for LUMIRA, LUMIRA VENTURES, and LUMIRA CAPITAL, and all related designs and logos. The use or misuse of these trademarks, copyrights or any other materials, except as permitted herein, is expressly prohibited and may be in violation of copyright law, trademark law, or other laws.
